Returns Policy

Interpretation
In these Terms and Conditions (‘Terms’) the following words have the following meanings:
‘Website’ – the Xpec website: www.xpec.co.uk
‘We/Us’ – Xpec Limited
‘You’ – a user of the Website
‘Goods’ – goods supplied by Us through the Website

Access to the Website
Free access to the Website is on condition that you accept these Terms.

Prices and descriptions
We take all reasonable care to ensure that prices, descriptions and information on the Website are accurate and correct at the time of publication. The imagery on the Website is for illustration only, and is a reasonable representation of the Goods. From time to time, due to our continuous policy of product development and improvement, there may be minor variations or amendments and the actual Goods and packaging may vary from the imagery on the Website. Essences and other materials used in our formulations contain natural products and there may consequently over a period of time be minor variation in the smell of the finished products.

We will only accept orders if there are no material errors in the description or price of Goods as displayed on the Website. The total cost of your order will be the price of the Goods including VAT at the current rate and applicable delivery charges as set out in the relevant section of the Website.

Personal information and account details
Your Personal Information will be treated as confidential. By placing an order on the Website you warrant that all the information which you are required to provide when you register as a customer or place an order for Goods is true, accurate and current in all respects and that you will contact us immediately should any change in this information occur. You authorise us to use your Personal Information in accordance with our Privacy Policy to process your order and administer your account.

By using the Website, you agree to keep your password and account details confidential, and to take all reasonable measures to prevent unauthorised access to your account. You are responsible for all actions that occur in relation to your account. If you have reason to believe that your password has become compromised, or your account could be used in any way that is unauthorised by you, you should contact us immediately in writing or by email: customerservice@xpec.co.uk. We comply fully with all applicable UK data protection and consumer legislation. Refer to our Privacy Policy.

Acceptance, contract and eligibility
We will acknowledge receipt of your order by email. An acknowledgement does not constitute our acceptance of your order or a contract between us. Orders will be accepted at our discretion and we reserve the right not to accept a particular order.

A contract will be made between us at the time we notify you by email that your order is confirmed. Your order will be confirmed after we receive authorisation of your credit/debit card payment or your cheque payment has been cleared. Payment must be made in accordance with the instructions on the Website and card payments will be debited from your account at the time your order is submitted to us.

If for any reason we are unable or unwilling to process your order, we will notify you and arrange a full refund. If your payment is not authorised or rejected by your card issuer or bank, we will not be liable for any delay, inconvenience, non-acceptance or non-delivery of your order.

We will only accept your order if you are 18 years of age or over and are eligible lawfully to form contracts under English law. The completion of the contract will take place at the time the Goods are dispatched.

Delivery
We will, through our elected delivery company, deliver Goods to the delivery address specified in the order. The delivery company and the estimated delivery times may vary from time to time but the delivery method, estimated times and any options will be shown on the Website. We cannot deliver orders to PO Box numbers.

Delivery of Goods will be subject to the policy of the delivery company elected by us. In the event that the recipient of the Goods is absent from their address at the time of delivery, it will be the responsibility of the recipient to retrieve the Goods according to the policy of the delivery company. We make every effort to fulfil and dispatch orders within a reasonable time, and any dates or times specified on the Website are an estimate only.

From time to time, subject to the availability of products, it may be possible only partially to fulfil a particular order. In this case we will contact you before the order is accepted so that you may decide whether to amend or cancel the order.

The risk in the Goods will transfer to you upon delivery. You will be deemed to have accepted the order upon receipt unless you notify us immediately of any problem, or you cancel the order or return the Goods in accordance with your cancellation rights or our returns policy.

Cancellation
Xpec Limited will operate in accordance with current Distance Selling regulations. You have the right to cancel an order provided that you give us notice in writing within 7 working days of receipt of the Goods. The Goods must be returned to us unopened, unused, in their original condition, in their original packing and at your cost. You may notify us of your cancellation by email at customerservice@xpec.co.uk. We will refund your payment, less delivery charges and any costs incurred to us for recovery of the Goods, within 30 days of our receipt of the proper notice of cancellation. The risk in the Goods will transfer to us upon their receipt by us.

Returns
Any Goods that are damaged or faulty will be replaced or refunded by us. If you are not satisfied with any of the Goods, we will arrange for an exchange, replacement or refund, provided that they are returned to us within fourteen days of your receipt, that they are in their original, unopened and unused condition, and that you notify us in writing stating the reason for return and whether you require an exchange, replacement or refund. You may notify us of your return by email at customerservice@xpec.co.uk. Toiletries products that have been opened cannot be returned for reasons of hygiene.

Your payment for the goods will be refunded as soon as possible by the original payment method, within 30 working days of our receipt of the returned Goods. We reserve the right, if appropriate, to deduct up to 15% from the refund value as a restocking fee. Please note that, except in the case of faulty or damaged Goods, delivery charges will not be refunded.

Refer to our Returns Policy and Procedure. Your United Kingdom statutory rights are not affected.

Use and resale
It is your responsibility to ensure that the Goods will be used in the correct manner. You agree not to offer the Goods for resale either within the United Kingdom or elsewhere.

Intellectual Property
All material on the Website including, but not limited to, our trademarks, our logotypes, imagery, text, and the product and pack designs that are illustrated, are the property of Xpec Limited unless otherwise stated. Other trademarks are the property of their respective owners.

Save for browsing, printing or downloading for personal, non-commercial use only, or actions reasonably required to progress the online purchase of Goods, nothing on the Website may be copied, stored, transmitted, republished or re-purposed. You will be liable for any damage or harm arising from an infringement of our intellectual property rights if that damage or harm results from your act, omission or default.

Liability
We make no representation or any warranty, condition or other term, or any duty under these Terms or under common law, express or implied, in relation to the Website and its content, or any activity on or through the Website, or in relation to any of our products, including, but not limited to, implied warranties of merchantability, satisfactory quality and fitness for a particular purpose. Our liability to you in contract, tort or otherwise for loss, damage, interruption of business or any special, indirect or consequential damage, is limited and excluded to the fullest extent permitted by law except in the case of death or personal injury caused by our negligence.

We take all reasonable care when providing links or references to third party websites, companies, products or entities and such links or references are provided for your information only and for use at your sole discretion. A link to a third party website does not mean that we endorse or accept any responsibility for the use or the content of such a website. We make no representations of any kind about any other website that you may access as a result of visiting the Website, whether or not a link is provided. We shall under no circumstances be liable for any consequential, indirect or economic loss or damage or offence that may arise.

We shall not be liable for any loss, damage or interruption of business or any special, indirect or consequential damage suffered by you in consequence of your transmitting information electronically through the Website.

General
You agree that these Terms, in conjunction with our Privacy Policy, constitute the complete and exclusive agreement between us concerning the Website and any purchase of Goods by you, and that they supersede and govern all prior agreements, proposals and other communications.

Information on the Website is provided as seen, without warranty of any kind and may not be timely, accurate or complete and may contain errors or omissions. Information, including prices, may be changed or updated at any time without notice.

We reserve the right to vary these Terms at any time. In respect of Goods ordered on the Website the Terms that apply shall be those that were accepted at the time the order was placed.

We reserve the right to refuse to supply Goods to any person or entity for any reason. We may withdraw any items from, remove any content from, or modify the Website at any time.

Applicable Law and Jurisdiction
These Terms, the Website and all of the content, all activity thereon and all contracts entered into shall be governed in all respects in accordance with the Laws of England and Wales. You submit irrevocably to the exclusive jurisdiction of the Court of England and Wales.

If any part of these Terms is found to be void or unenforceable by any court of competent jurisdiction, such part shall be severed from these Terms, which will otherwise remain in full force and effect.

All contracts and communications shall be made in English.
